Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Not Your Lawyer (“NYL,” “Service”) provided by Not Your Lawyer, Inc. (“Company”). By creating an account or using the Service, you agree to these Terms. If you are using NYL on behalf of a law firm, you represent that you have authority to bind the firm to these Terms.

1. The Service

NYL is a practice management platform designed for personal injury law firms. The Service includes case management, AI-assisted case evaluation, lien network access, IOLTA trust accounting tools, SOL tracking, client intake, document generation, and related features.

Not legal advice. NYL is a software tool. Nothing in the Service constitutes legal advice, and NYL does not create an attorney-client relationship. All legal judgments remain the sole responsibility of the licensed attorney using the platform.

2. Accounts and Access

You must provide accurate registration information and maintain the security of your credentials. You are responsible for all activity that occurs under your account. Notify us immediately at simon@notyourlawyer.ai if you suspect unauthorized access.

You may not share login credentials across multiple users. Each user must have their own account under your subscription.

3. Subscriptions and Billing

NYL is offered on a subscription basis. Fees are billed monthly in advance. All fees are non-refundable except as required by applicable law or as explicitly stated in a written agreement.

We may change subscription pricing with 30 days' written notice. Continued use after the effective date constitutes acceptance of the new pricing.

Founding tier subscribers are rate-locked at their initial price for the duration of their subscription, provided the subscription remains active and in good standing.

4. Your Data

You retain ownership of all data you enter into NYL, including client information, case files, and documents. By using the Service, you grant NYL a limited license to store, process, and display your data solely to provide the Service to you.

You are responsible for ensuring that your use of NYL complies with applicable attorney ethics rules, including rules regarding client confidentiality, data security, and supervision of non-lawyer assistants and technology tools.

5. Acceptable Use

You agree not to: use the Service for any unlawful purpose; upload malicious code; attempt to gain unauthorized access to other accounts or systems; resell or sublicense the Service without written consent; or use AI features to generate content you represent as solely your own legal work product without attorney review.

6. AI Features

NYL includes AI-powered features including case scoring, document drafting assistance, and intake processing. AI outputs are provided for informational purposes only and require attorney review before use. NYL does not guarantee the accuracy, completeness, or legal sufficiency of AI-generated content.

7. IOLTA Compliance

NYL provides trust accounting tools to assist with IOLTA compliance. These tools do not substitute for attorney oversight of client trust funds. You are solely responsible for compliance with your state bar's IOLTA rules, including segregation of client funds, timely disbursement, and reconciliation.

8. Termination

Either party may terminate this agreement at any time with 30 days' written notice. NYL may suspend or terminate accounts immediately for material breach, fraud, or non-payment. Upon termination, you may export your data within 30 days before it is deleted.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. NYL DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF SECURITY VULNERABILITIES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NYL'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

NYL IS NOT LIABLE FOR ANY MISSED STATUTE OF LIMITATIONS, LOST CASES, MALPRACTICE CLAIMS, OR OTHER LEGAL CONSEQUENCES ARISING FROM YOUR USE OR MISUSE OF THE PLATFORM.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.

11. Changes to Terms

We may update these Terms at any time. We will notify you via email or in-app notification at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance.
